1. Acceptance of Terms

By accessing and using Canada Adventures' services, you accept and agree to be bound by the terms and provision of this agreement. These Terms of Service apply to all visitors, users, and others who access or use our adventure recreation services.

If you do not agree to abide by the above, please do not use our services. We reserve the right to change these terms at any time, and your continued use of the service constitutes acceptance of any changes.

2. Description of Service

Canada Adventures provides outdoor recreation and adventure tourism services including but not limited to mountain hiking, water sports activities, winter sports instruction, and guided wilderness expeditions throughout Canada.

Our services include professional guide instruction, equipment rental, safety briefings, and educational experiences in natural environments. All activities are conducted with certified instructors and professional-grade equipment.

We strive to provide accurate information about our services, but we do not warrant that service descriptions or other content is accurate, complete, reliable, current, or error-free.

3. User Responsibilities and Conduct

Participants must provide accurate health and fitness information during booking. You are responsible for ensuring you meet the physical requirements for chosen activities and for disclosing any medical conditions that may affect your participation.

You agree to follow all safety instructions provided by our guides and instructors. Failure to comply with safety protocols may result in removal from activities without refund.

Participants must be respectful of fellow adventurers, guides, wildlife, and natural environments. Any destructive or disrespectful behavior may result in immediate termination of services.

You are responsible for your personal belongings during all activities. Canada Adventures is not liable for lost, damaged, or stolen personal items.

4. Booking and Payment Terms

All bookings require advance payment or deposit as specified during the booking process. Full payment is typically required 48 hours before the scheduled activity unless otherwise specified.

Prices are subject to change without notice. However, bookings confirmed with payment will honor the agreed-upon price at the time of booking.

Group bookings may require different payment terms and are subject to separate agreements outlined in group booking contracts.

All payments are processed securely through authorized payment processors. We do not store credit card information on our systems.

5. Cancellation and Refund Policy

Cancellations made more than 72 hours before the scheduled activity are eligible for full refund minus processing fees. Cancellations made 24-72 hours in advance receive 50% refund.

Cancellations made less than 24 hours before the activity or no-shows are not eligible for refunds unless due to extreme weather conditions or safety concerns as determined by Canada Adventures.

We reserve the right to cancel activities due to weather conditions, insufficient enrollment, or safety concerns. In such cases, full refunds or rescheduling options will be provided.

Refunds are processed within 7-10 business days and returned to the original payment method.

6. Assumption of Risk and Liability

Outdoor recreation activities involve inherent risks including but not limited to physical injury, property damage, or death. By participating in our activities, you acknowledge and assume these risks.

Participants must sign liability waivers before engaging in any activities. These waivers are legally binding and limit Canada Adventures' liability for injuries or damages that may occur during activities.

Canada Adventures maintains appropriate insurance coverage, but participants are encouraged to obtain their own travel and medical insurance coverage.

Our liability is limited to the amount paid for the specific activity in question. We are not liable for indirect, incidental, or consequential damages.

7. Age Requirements and Supervision

Minimum age requirements vary by activity and are clearly stated in activity descriptions. Participants under 18 must have parental consent and may require adult supervision for certain activities.

Parents or guardians are responsible for supervising their children and ensuring they follow all safety guidelines. Adult supervision ratios are maintained according to industry safety standards.

Special youth programs have trained instructors experienced in working with younger participants and maintain appropriate safety protocols.

8. Equipment and Safety

All equipment provided by Canada Adventures meets or exceeds industry safety standards and is regularly inspected and maintained by certified technicians.

Participants are responsible for the proper use of provided equipment and must report any equipment concerns immediately to guides or staff.

Personal protective equipment must be worn as instructed. Failure to use safety equipment properly may result in activity suspension.

Participants may use personal equipment with guide approval, but such equipment must meet safety standards and be in good working condition.

9. Privacy and Data Protection

We collect and use personal information in accordance with our Privacy Policy. By using our services, you consent to the collection and use of information as outlined in our privacy policy.

Photos and videos may be taken during activities for promotional purposes. Participants will be notified and may opt out of being featured in promotional materials.

We implement appropriate security measures to protect personal information and do not sell or share personal data with unauthorized third parties.

10. Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of Canada Adventures and is protected by copyright and trademark laws.

You may not reproduce, distribute, modify, or create derivative works of our content without explicit written permission.

Participants retain rights to their personal photos and experiences but grant Canada Adventures permission to use testimonials and feedback for promotional purposes.

11. Force Majeure

Canada Adventures is not liable for delays or cancellations due to circumstances beyond our control, including but not limited to natural disasters, extreme weather, government restrictions, or public health emergencies.

In such cases, we will work with participants to reschedule activities or provide appropriate refunds or credits as circumstances permit.

We monitor weather and safety conditions continuously and prioritize participant safety over activity completion.

12. Governing Law and Dispute Resolution

These terms are governed by the laws of the Province of Alberta, Canada, without regard to its conflict of law principles.

Any disputes arising from these terms or your use of our services will be resolved through binding arbitration in Calgary, Alberta, unless prohibited by applicable law.

Both parties waive the right to trial by jury and to participate in class action lawsuits or class arbitrations.
